These Terms govern your use of BROOKS&GRANT Competitions and provide information about our service. By entering our competitions, creating an account, purchasing tickets, or otherwise interacting with our website, you agree to these Terms.
The BROOKS&GRANT service is provided by BROOKS&GRANT Limited. These Terms constitute a legally binding agreement between you (the “User”) and BROOKS&GRANT Limited (“we,” “us,” or “our”), concerning your access to and use of the brooksandgrant.com website and related services.
ACCEPTANCE OF TERMS
- Age Requirement: You are at least 18 years old. Participation by individuals under the age of 18 is strictly prohibited.
- Legal Capacity: You are legally capable of entering into binding contracts.
- Agreement: You agree to abide by these Terms and Conditions, our Privacy Policy & Cookies, and any other rules or policies referenced herein.
- Jurisdictional Compliance: You are accessing the Service from a jurisdiction where it is legal to participate in skill-based competitions. It is your responsibility to ensure compliance with the laws of your jurisdiction.
- Account Accuracy: You will provide accurate, current, and complete information when creating and maintaining your account. Failure to provide accurate information may result in disqualification from competitions or forfeiture of prizes.
- One Account Per Person: You are permitted to hold only one account. Multiple accounts created by the same individual are prohibited and may result in suspension or disqualification.
- Eligibility to Participate: You meet all eligibility criteria as described in the specific competition details.
- Responsible Participation: By entering a competition, you acknowledge that the competitions are skill-based, and you have read and understood the rules associated with each competition.
If you do not meet these conditions, you may not use our Service.
COMPETITIONS
BROOKS&GRANT operates as a skills-based competition platform. Entry into our competitions requires participants to correctly answer a skill-based question, ensuring that all competitions comply with applicable laws and regulations.
- Live Draw: These competitions have a scheduled draw time. All entries must be completed before the draw time. Participants must ensure their answers and tickets are submitted correctly before the deadline.
- Auto-Draw: These competitions are drawn automatically when all tickets are sold. Participants should enter early to secure their spot and must answer the required skill-based question correctly for their entry to qualify.
Failure to answer the skill-based question correctly will result in disqualification, and your entry will not be processed. Always ensure your answers are accurate to maximise your chances of participation.
Answering the correct answer reveals the buy tickets button. This ensures that users cannot proceed without answering the correct question.
Each competition is governed by specific rules, including entry fees, prize details, and deadlines. These rules are outlined on the competition page. Your entry is confirmed upon successful payment and issuance of your unique ticket number(s).
- Each ticket represents an entry into the competition and is assigned a unique number upon purchase. Ticket numbers are non-refundable and non-transferable once issued.
- Winners are chosen randomly and will be notified via the contact information provided during entry. It is your responsibility to ensure your details are correct and up-to-date. BROOKS&GRANT is not responsible for missed notifications due to incorrect or outdated information.
- Prizes are dispatched within 30 days of winner confirmation. For physical prizes, delivery times may vary depending on the winner’s location.
- BROOKS&GRANT reserves the right to verify winner eligibility before awarding prizes, including checking compliance with these Terms & Conditions.
- Winners must respond to prize notifications within 7 days. Failure to respond will result in forfeiture of the prize, and a new winner may be drawn.
- Refunds or credits will only be provided if BROOKS&GRANT cancels a competition.
- Any attempts to manipulate the competition system, such as using multiple accounts, submitting false information, or automated entries, will result in immediate disqualification and account suspension.
Failure to answer the skill-based question correctly will result in disqualification, and your entry will not be processed. Always ensure your answers are accurate to maximise your chances of participation.
TICKETS
- Entry Confirmation: Your entry is confirmed upon successful payment and issuance of a unique ticket number(s).
- Ticket Numbers: Ticket numbers are issued via email upon successful payment. You can also view your ticket numbers on the order details page in the "My Account" section of the website.
- Ticket Limit: The maximum number of tickets allowed per entrant is detailed on the competition page. Entrants must adhere to these limits to ensure fairness.
- Non-Transferable: Tickets are non-transferable and non-refundable once issued.
- Duplicate Entries: Any attempt to purchase tickets beyond the allowed limit or to use multiple accounts for entry will result in disqualification.
- Ticket Validity: Ticket numbers are valid only for the competition they were purchased for and cannot be transferred to another competition.
- Payment Issues: If your payment is not successfully processed, your entry will not be confirmed, and no ticket numbers will be issued.
WINNER SELECTION
- Random Selection: Winners are chosen randomly from all eligible entries after verifying the correctness of the skill-based question.
- Notification: Winners will be notified via the contact information provided on their account, including email, phone number, and delivery address.
- Account Accuracy: It is your responsibility to ensure your contact details are accurate and up to date. BROOKS&GRANT will not be held responsible for delays or issues caused by incorrect or outdated account information.
- Claim Period: If we cannot contact the winner within 7 days of the draw, a new winner will be selected. We recommend ensuring your account details are current to avoid missing important notifications.
- Account Verification: Winners may be required to verify their identity and eligibility to receive the prize. Failure to provide requested documentation may result in disqualification.
- Prizes: Prizes will be processed and dispatched only after the winner's eligibility and account details have been verified.
- Public Announcement: BROOKS&GRANT reserves the right to publicly announce the winner’s name (e.g., first name and initial of the last name) for transparency purposes, unless the winner explicitly requests otherwise.

Disqualification: Any entrant found to have provided false or misleading information during entry or account creation, including age, will be disqualified, and the prize will be forfeited without refund.
PAYMENTS
- Accepted Payment Methods: We accept most major credit and debit cards, including Visa, Mastercard, and others. Unfortunately, we do not accept American Express at this time.
- Secure Transactions: All payments are processed through a secure and encrypted payment gateway to ensure the safety of your personal and financial information.
- Immediate Payment: Payment must be completed at the time of ticket purchase. Entries are only confirmed once payment is successfully processed, and tickets are issued.
- Accuracy of Billing Details: Please ensure that all billing details provided during checkout are accurate. Incorrect or incomplete billing information may delay ticket issuance or result in a failed transaction.
- Fraud Prevention: We reserve the right to decline transactions suspected of fraudulent activity. If your payment is flagged for review, you may be required to provide additional verification.
- Currency: All payments are processed in GBP (ÂŁ). If you are purchasing from outside the United Kingdom, your bank may charge additional fees for currency conversion or international transactions.
- Receipts and Confirmation: Upon successful payment, a confirmation email with your ticket numbers will be sent to the email address associated with your account. You can also view your tickets in the "Order Details" section under "My Account."
- Payment Disputes: If you encounter issues with your payment, please contact us immediately at support@brooksandgrant.com. We will assist in resolving the issue as quickly as possible.
REFUNDS & CANCELLATIONS
- Non-Refundable Entries: Competition entries are non-refundable once payment is confirmed, except in cases explicitly stated in the competition terms and conditions.
- Competition Cancellations: If a competition is canceled, all participants will receive a full refund of their entry fees. Refunds will be processed within 14 business days and returned to the original payment method.
- Incorrect Entry Submissions: Entries submitted with incorrect or incomplete information, such as an incorrect answer to the skill-based question, will not be refunded.
- Ticket Transfers: Tickets are non-transferable and cannot be exchanged for another competition or cash value.
- Refund Process: In eligible cases, refunds will be initiated promptly. However, the exact timing may vary depending on your bank or card issuer's processing times.
- Cancellation of Orders: If you wish to cancel an order due to an error, please contact us immediately at support@brooksandgrant.com. Cancellations will only be considered if the competition has not yet started and the tickets have not been issued.
- Disqualification: Disqualified entries, including those resulting from a failure to adhere to competition rules or incorrect account information, are not eligible for refunds.
AVAILABILITY
- Competition Availability: All competitions are subject to availability and may be withdrawn or modified at any time without prior notice. This includes, but is not limited to, competitions where ticket sales have not met the minimum threshold or due to unforeseen circumstances.
- Ticket Availability: Tickets for competitions are limited and issued on a first-come, first-served basis. Once all tickets are sold, entries for the competition will close.
- Right to Amend: BROOKS&GRANT reserves the right to cancel, amend, or suspend any competition if necessary, such as due to technical issues, fraud, or circumstances beyond our control.
- No Guarantee: We cannot guarantee entry into a competition if tickets have sold out, the competition has ended, or there are errors in your submission or account information.
- Early Closure: Auto-draw competitions will close automatically when all tickets are sold, even if this occurs before the advertised deadline. Participants are encouraged to enter early to secure their spot.
- Notification of Changes: While we strive to keep participants informed of any changes, it is your responsibility to regularly check competition pages for updates or modifications.
FREE ENTRY
- Equal Opportunity: Free postal entries are treated the same as paid entries and are included in the same draw, with no preferential treatment given to either type.
- Entry Limit: Free postal entries are limited to one per person, per competition.

Required Details: Postal entries must include the following:
- Your full name
- Your complete address
- Your email address
- Your phone number
- Your customer ID (found in your account)
- The competition ID
- The correct answer to the skill-based question (if applicable)
- Entry Deadline: Postal entries must be received at least 24 hours before the competition draw time. Late entries will not be included.
- Responsibility: BROOKS&GRANT is not responsible for postal delays, lost entries, or incomplete submissions. It is the entrant’s responsibility to ensure their entry arrives on time with all required details.
- Submission Format: Postal entries must be sent on an unenclosed postcard to the address specified in the Postal Entry Terms.
- Verification: All postal entries will be verified for compliance with the competition rules. Non-compliant entries will be disqualified.
- Account Registration: You must create an account on our website before submitting a postal entry. Failure to match your entry details with your account will result in disqualification.
PRIVACY & DATA PROTECTION
- Privacy Policy & Cookies: Your use of our Service is governed by our Privacy Policy & Cookies. By using our Service, you consent to the collection and use of your information as outlined in these policies.
- Data Protection: We are committed to protecting your personal data and ensuring compliance with applicable data protection laws.
- No Data Selling: We do not sell your personal data to third parties.
- Data Sharing: We may share your data within our group of companies for legitimate business purposes, such as improving our services or for operational needs.
- Cookies & Analytics: We use cookies and analytical tools (e.g., Google Analytics) to enhance your user experience, monitor website performance, and understand user behavior.

PRIZES
- Delivery Timeline: Prizes are dispatched within 30 days of winner confirmation, unless otherwise specified on the competition page.
- Delivery Responsibility: While we strive for timely delivery, we are not responsible for delays caused by external factors such as customs clearance, courier services, or inaccurate delivery information provided by the winner.
- Ownership Transfer: Prizes become the property of the winner upon successful delivery.
- Prize Images & Descriptions: Images of prizes on the competition page are for reference only. The actual prize may vary slightly in appearance, but all specifications are detailed on the prize page.
- No Substitutions: Prizes cannot be exchanged, substituted, or redeemed for cash or any alternative, unless explicitly stated in the competition rules.
- Verification & Eligibility: Winners may be required to provide additional identification or proof of eligibility before the prize is awarded. Failure to meet eligibility requirements may result in forfeiture of the prize.
- Forfeited Prizes: If a winner cannot be contacted or fails to claim their prize within 7 days of notification, BROOKS&GRANT reserves the right to select an alternate winner.
- Manufacturer’s Warranty: For physical prizes, any applicable warranties are provided by the manufacturer. BROOKS&GRANT is not responsible for defects or issues covered by the manufacturer’s warranty.
- Non-Transferability: Prizes are awarded to the registered account holder and cannot be transferred to another person or entity.
- Tax Obligations: Winners are solely responsible for any applicable taxes or duties associated with the prize in their jurisdiction.
SHIPPING & DELIVERY
- UK Delivery: All deliveries within the UK are free of charge.
- Delivery Methods: Prizes may be hand-delivered, posted, or sent digitally, depending on the prize type and winner's location.
- International Shipping Costs: For prizes shipped outside of the UK, the winner is responsible for covering all shipping and delivery costs. These costs must be paid before the prize is dispatched.
- Customs Duties & Taxes: Prizes shipped internationally will be sent Delivery Duty Unpaid (DDU), meaning the winner is responsible for paying any applicable customs duties, taxes, or fees in their jurisdiction.
- Declared Value for Customs: The value of the prize will be declared at its full and current retail value for import duty purposes. BROOKS&GRANT will not amend or under-declare this value under any circumstances.
- Insurance & Responsibility: Once the prize has been dispatched, BROOKS&GRANT is not responsible for damage, loss, or delays caused during transit. It is the winner's responsibility to ensure they can receive the prize at the provided address.
- Delivery Timelines: While we strive to ensure timely delivery, actual delivery times may vary based on location, courier services, or customs clearance processes. BROOKS&GRANT cannot guarantee delivery timelines for international shipments.
- Storage Fees: If a prize requires special handling, storage fees, or additional delivery arrangements, these costs will be the winner’s responsibility. Failure to make necessary arrangements within a specified timeframe may result in forfeiture of the prize.
- Failure to Deliver: If a prize cannot be delivered due to incorrect or incomplete address details provided by the winner, BROOKS&GRANT is not liable for replacement or additional shipping costs.
RETURNS & FAULTY ITEMS
- Notification of Faults: If your prize is damaged or faulty upon receipt, you must notify us within 3 days by emailing support@brooksandgrant.com. Please include your order details, a description of the issue, and supporting photographs or videos.
- Inspection Process: Once notified, we will review your claim and may request additional information to assess the issue before proceeding.

Resolution: BROOKS&GRANT reserves the right to determine the appropriate resolution for faulty items. This may include:
- Repairing the item if feasible.
- Replacing the item with an identical or equivalent prize.
- Issuing a refund if repair or replacement is not possible. Refunds will be limited to the value of the winning ticket price, not the retail value of the prize.
- Return Shipping: If a physical return is required, BROOKS&GRANT will provide instructions and cover return shipping costs for faulty items within the UK. For international returns, the winner may be required to cover shipping costs upfront, which will be reimbursed if the claim is valid.
- Refund Value: If a refund is deemed the appropriate resolution for a faulty or damaged prize, the refund will be limited to the value of the ticket price paid for the winning entry, not the retail value of the prize.
- Exclusions: Claims for faults or damages reported beyond the 3-day notification period will not be eligible for resolution. Normal wear and tear, misuse, or damage caused by the winner is not covered.
- Digital Prizes: For digital prizes (e.g., gift cards or codes), issues such as invalid codes or delivery errors must be reported immediately upon receipt.
- Final Decision: The decision to repair, replace, or refund a prize is at the sole discretion of BROOKS&GRANT and is considered final.
INTELLECTUAL PROPERTY
- Ownership: All content on our site, including text, images, logos, designs, and graphics, is the property of BROOKS&GRANT Limited and is protected under applicable copyright, trademark, and intellectual property laws.
- Unauthorised Use: Any unauthorised reproduction, distribution, modification, or use of our content, including for commercial purposes, is strictly prohibited and may result in legal action.

- Global Accessibility: While our competitions are available globally in jurisdictions where such competitions are lawful, you acknowledge that they are subject to the laws of England and Wales, regardless of your country of residence or participation.
- Compliance with Local Laws: It is your responsibility to ensure that participating in our competitions does not violate the laws of your jurisdiction. BROOKS&GRANT is not liable for any breaches of local laws resulting from your participation.
- Legal Enforcement: In the event of a legal dispute, you agree to bear any costs associated with bringing your claim in England and Wales, unless otherwise required by applicable law.
DESCRIPTIONS & PRIZE INFORMATION
- Competition Details: All competition details, including entry fees, prize descriptions, deadlines, and eligibility requirements, are clearly provided on the respective competition page.
- Prize Information: Prizes are described as accurately as possible based on the information available at the time. Images and descriptions are for illustrative purposes only and may differ slightly from the actual prize.
- Accuracy: While we make every effort to ensure the accuracy of information presented, BROOKS&GRANT does not guarantee that all descriptions, details, or specifications are error-free.
- Errors and Omissions: In the event of an error or omission in the description of a competition or prize, BROOKS&GRANT reserves the right to correct the information without prior notice.

- Account Security: Users are responsible for maintaining the confidentiality of their account credentials. BROOKS&GRANT will not be held liable for unauthorized access due to user negligence.

- Fair Play: Any attempt to manipulate competition outcomes, circumvent entry limits, or engage in fraudulent behavior will result in immediate disqualification and possible legal action.
FAIR USE & ANTI FRAUD POLICY
- Fraud Detection: BROOKS&GRANT actively monitors entries for suspicious or fraudulent activity. This includes, but is not limited to, automated entries, duplicate accounts, or falsified information.
- Disqualification: Any participant found to be in breach of our Terms, including attempts to exploit system vulnerabilities, will be disqualified without refund.
- Random Selection Integrity: All winner selections are conducted transparently and verified to ensure fairness.
LIMITATION OF LIABILITY
- No Warranty: BROOKS&GRANT makes no warranties, express or implied, regarding the Service or prizes.
- External Factors: We are not responsible for issues caused by external factors, such as courier delays, customs charges, or technical issues beyond our control.
- Liability Cap: Our liability for any claim is limited to the total value of the tickets purchased for the affected competition.
AMENDMENTS TO TERMS
BROOKS&GRANT reserves the right to amend these Terms at any time. Any changes will be posted on this page and take effect immediately unless otherwise specified. It is your responsibility to review these Terms regularly to stay informed of updates. Continued use of our Service constitutes acceptance of the amended Terms.
COMPLAINTS & DISPUTE RESOLUTION

- Response Time: We aim to respond to complaints within 5 business days.
